In France, hemp products are permitted up to 0.3% THC: flowers and resins have been freely sold since the Council of State annulled their ban at the end of 2022. Ingestible extracts (oils, food supplements), however, remain blocked pending an EU "Novel Food" authorisation — only cosmetic and non-food uses are open, and controls on foods tightened in spring 2026.

Key points

• 19 novembre 2020 — CJEU "Kanavape" ruling (C-663/18): CBD is not a narcotic and its free movement between Member States cannot be hindered without proportionate justification.
• 30 décembre 2021 — Interministerial order: the threshold rises from 0.2% to 0.3% THC for hemp cultivation and commercial use, but the sale of raw flowers and leaves to consumers is prohibited.
• 24 janvier 2022 — The Council of State's interim-relief judge suspends this ban.
• 29 décembre 2022 — The Council of State definitively annuls the ban: flowers and leaves ≤ 0.3% THC are freely marketable.
